艾伯特基金会北京代表处与中国政法大学共同举办基本权利给付功能研讨会。
在德国，基本权利既有保护性维度，也有利益性维度，后者可以理解为国家给予的自由。此外，还对原始权利和派生权利进行了区分。立法者在平衡公民的个人利益诉求与整个社会的平衡时有足够的操作空间。由于基本社会权利没有写入德国基本法，因此，公民个人对国家的利益要求通常只有依据各自相关法律规定的社会政策而存在。
德国联邦宪法法院前法官莱因哈特·盖尔教授（Reinhard Gaier）、萨克森-安哈尔特州社会法庭主审法官托马斯·哈克斯博士（Thomas Harks）以及比勒费尔特大学的瓦妮莎·赫尔曼女士（Vanessa Hellmann）与中国政法大学的同行展开交流，双方都通过实际司法案例进行了阐释。
